The structure of Article 14

The first capability requires oversight persons to fully understand what the system can and cannot do. This is more demanding than reading the product brochure. It means that the person assigned to oversight must be able to identify situations where the system is operating at the edge of its intended purpose, where input conditions diverge from those on which the model was trained, and where the confidence level of an output is insufficient to act on without further review. 2. Monitoring operation

The second capability requires ongoing operational monitoring. Monitoring means more than periodic audit. It requires a real-time or near-real-time view of what the system is doing, at a level of detail sufficient to detect malfunctions before they cause harm. This does not always require a human watching every output. It does require instrumentation that surfaces anomalies and alerts oversight persons when intervention thresholds are crossed. 4. Interpreting outputs

The fourth capability addresses the interpretability requirement. Oversight persons must be able to understand what the system's output means in the specific context in which the system is operating. This is the capability most often compromised in real deployments: the person nominally responsible for oversight does not have the domain knowledge to evaluate the output, or the system does not expose enough of its reasoning to allow meaningful review. The EIOPA supervisory statement on AI in insurance, published in August 2025, specifically noted this gap in insurance AI deployments. A system whose outputs are opaque to its oversight persons is not effectively supervised.

5. Override, interrupt, and halt

The fifth capability is the safeguard of last resort. The system must be designed with a mechanism that allows oversight persons to override a specific output, interrupt a process, or halt the system entirely when the risk of continued operation exceeds acceptable levels. This mechanism must be accessible and effective. A halt procedure that requires escalating through three management levels before anyone can stop the system is not effective oversight. Competence means the combination of knowledge, skills, and experience required to perform each of the five Article 14(4) capabilities. A person who lacks the domain knowledge to interpret an AI output cannot be competent oversight for that system, regardless of their seniority.

Training means structured preparation specific to the system and its use case. Generic AI literacy training does not satisfy it. The oversight persons must have been trained on the specific system, its known failure modes, the detection methods in the oversight register, and the response procedures for each type of dysfunction.

Authority means the formal organisational power to act on what oversight reveals. An oversight person who can detect a dysfunction but lacks the authority to pause the system, escalate to a decision maker, or communicate with the provider has not been given effective oversight responsibility. The oversight register must name the persons, their authority levels, and the escalation path that reaches a decision maker who can halt the system.

Support means access to the tools, data, and organisational resources the oversight person needs to function. This includes access to logs, alerts, provider documentation, and a channel to the provider for technical issues. It also includes protected time. An oversight person who is expected to review AI outputs while carrying a full separate workload has not been given adequate support.

Where the design obligation ends and the staffing obligation begins

A frequent question in compliance preparation is who is responsible when oversight proves inadequate in practice. The answer depends on which obligation was not met. If the system was not designed with an effective halt mechanism, the provider has failed Article 14(3). If the system had a functional halt mechanism but no named person with the authority to activate it, the deployer has failed Article 26(2). If the person was named but lacked the training to detect the dysfunction that required halting, the deployer has again failed Article 26(2).

The practical consequence is that a deployer cannot rely on the provider's Article 14 compliance as a shield against Article 26 enforcement. The deployer must independently verify that the oversight mechanisms the provider has built are actually sufficient for the use case in which the deployer is running the system. A system designed for use by large financial institutions with dedicated AI governance teams may not provide adequate oversight infrastructure for a smaller organisation with a single compliance officer sharing responsibilities across multiple systems.

Where a deployer concludes that the provider's system does not support adequate oversight for the intended use case, the deployer has two options: request supplementary tooling from the provider, or restrict the use of the system to applications where the existing oversight infrastructure is sufficient. Deploying a system outside the operational scope supported by the oversight mechanisms is a breach of Article 26(1) as well as Article 26(2).

Documentation requirements

The Article 14 compliance position requires a coherent set of documents. The minimum is an oversight register, an oversight training record, and a documented halt and escalation procedure. These three documents correspond to the three elements of Article 26(2): naming the persons, establishing their competence, and defining the authority and escalation path.

The oversight register should contain the name and role of each person assigned, the system or systems for which they are responsible, a description of their competence for each Article 14(4) capability, the tools and access rights they have been given, and the alert thresholds at which they are expected to intervene. It should be maintained as a live document and updated whenever personnel changes or system configuration changes require it.

The training record should specify, for each oversight person, the training received, the date completed, the training provider, the topics covered, and the refresher schedule. Generic AI Act awareness training should be distinguished from system-specific training. Only the latter contributes to the Article 26(2) competence requirement.

The halt and escalation procedure should be a one-page document that every oversight person can locate within thirty seconds. It should name the halt mechanism in the system interface, identify the authority level required to activate it, and set out the communication steps required after a halt, including notification to the provider and, where a serious incident has occurred, notification to the market surveillance authority under Article 26(5).
